Pour apprécier le bien-fondé des critiques dont elle est l objet, une étude de ses rapports avec l intérêt général était nécessaire. L intérêt général est au fondement de la reconnaissance des droits de propriété industrielle et en marque la finalité sociale qui apparaît comme être un outil d appréhension de ces droits. Il légitime son existence et guide la frontière entre la libre concurrence et la réservation en inspirant tant les définitions des objets appropriables que les conditions d accès au titre. Il imprime de sa marque les prérogatives conférées qui doivent être considérées comme des droits de propriété finalisés dont la protection est un objectif d intérêt général. Mais l intérêt général est aussi un facteur de limitation des prérogatives juridiques. Il dicte les limites, c est-à-dire le point au-delà duquel le droit n a plus vocation à jouer, dont la principale réside dans l épuisement du droit. D autres limites apparaissent à l aune d une lecture finaliste permettant de mieux cerner la portée des droits. L intérêt général impose certaines exceptions qui, en tant qu atteintes à un droit de propriété, doivent tirer leur légitimité d un motif d intérêt général. Il encadre également l exercice du droit. Le titulaire d un droit exclusif est tenu d une obligation d exploiter la marque et le brevet sanctionnée par la déchéance ou la licence imposée. Ces mécanismes de correction sont inspirés de la théorie de l abus de droit. En outre, le droit de la concurrence et notamment la théorie des facilités essentielles s applique aux droits de propriété industrielle. La présence de l intérêt général est transversale, il assoit la légitimité de la propriété industrielle en dictant une réservation conditionnée, mesurée et adaptée aux évolutions commerciales et technologiques | ||

To appreciate the validity of criticisms of which it is the object, a study of its relationship with the general interest was necessary. The general interest found the recognition of the rights of industrial property. It legitimates its existence and guides the border between the free competition and the reservation by inspiring the definitions of the appropriable objects as well as the conditions of access to the title. It prints of its mark the conferred prerogatives which must be regarded as finalized rights of property whose protection is an objective of general interest. But the general interest also dictates the limits, the point beyond of which the right does not have any more vocation to play, whose principal one resides in the exhaustion of the right. Others limits appear with a finalist reading allowing to better determine the range of the rights. The general interest imposes exceptions which, as attacks a right of property, must be founded on a general interest motive. It also frames the exercise of the right. The holder of an exclusive right is held of an obligation to exploit the mark and the patent sanctioned by the forfeiture or the imposed licence. Moreover, the right of the competition and in particular the theory of the essential facilities apply to the rights of industrial property. The presence of the general interest is transverse, it bases the legitimacy of the industrial property by dictating a reservation conditioned, measured and adapted to the commercial and technological evolutions | ||
