Le doyen Symeonides étudie l histoire de ce phénomène, mais regarde également vers l avenir pour tenter de découvrir quelle sera la nouvelle phase de développement des conflits de lois aux Etats-Unis. En s appuyant sur les décisions des tribunaux des États et des tribunaux fédéraux en matière de conflits de lois au cours des quatre dernières décennies, le doyen Symeonides étudie cette révolution en dix chapitres. Il présente ainsi le système américain traditionnel de conflits de lois et les oppositions qu il a suscité dans le monde académique (la scholastic revolution). Il décrit ensuite la manifestation judiciaire de cette contestation (la judicial revolution) et finalement l abandon du système traditionnel, considéré comme trop rigide. Le doyen Symeonides présente également le paysage méthodologique tel qu il se présente au XXIème siècle dans les différents États des Etats-Unis. Le doyen Symeonides s intéresse ensuite plus spécifiquement à la situation en matière de torts , parce que c est autour d eux que s est construite la révolution, et parce qu ils constituent un excellent vecteur pour examiner à nouveaux frais les fondements méthodologiques et philosophiques des règles de conflits de lois aux Etats-Unis. L auteur s attache ensuite à passer la situation actuelle des règles de conflits de lois américaines au crible de six critères méthodologiques et philosophiques, et propose une nouvelle étape dans l évolution des règles américaines de conflits de lois : le développement de nouvelles règles de conflits de lois intelligentes (smart) fondées sur l expérience américaine en matière de conflits de lois. | ||

Symeonides studies the historic background of this phenomenon, but also looks towards the future to try to discover what the next step in the evolution of American conflicts law should be. The author takes as basis for his study the choice-of-law decisions by American state and federal courts in the last four decades. The course consists of ten chapters. He reports first on the traditional American choice-of-law system and the dissent it generated in the academic world (the scholastic revolution). In the next chapter he chronicles the judicial manifestation of the same phenomenon (the judicial revolution) and the abandonment of the traditional system, considered as too rigid. He presents the methodological landscape as it exists in the various states of the United States at the beginning of the 21st century. The author then concentrates on tort conflicts, as they make up the main arena for the revolution and because they are an excellent vehicle for re-examining the methodological and philosophical foundations of American choice-of-law. In the last chapters the author explores the current position of American conflict law with regard to six methodological and philosophical benchmarks, and proposes a new step in the development of American conflicts law: the development of new "smart" choice-of-law rules, based on the American experience in conflicts of law. | ||
